Welcome to EverGlow Lighting LLC (“EverGlow Lighting”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website (the “Site”) and any services we provide (collectively, the “Services”). By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

1. Use of Our Website

1.1 Eligibility

You must be at least 18 years old to use our Services. By using our Site, you represent and warrant that you are of legal age to form a binding contract.

2.1 Lighting Consultations and Installation Services

EverGlow Lighting provides permanent exterior lighting services, including but not limited to consultations, estimates, design recommendations, installation of Govee lighting systems, and related services.

Specific details of your project (scope of work, pricing, timelines, and materials) will be outlined in a separate written or verbal agreement, estimate, or invoice between you and EverGlow Lighting. In the event of any conflict between these Terms and a signed written agreement, the written agreement will control.

2.2 Estimates, Booking, and Payments

-Estimates: Any estimate provided (verbally or in writing) is based on the information available at the time and may change if project scope, materials, or site conditions change.

-Booking: Project dates are scheduled based on availability, weather conditions, and access to the property. We reserve the right to adjust scheduling as needed.

-Payments: Payment terms (including deposits and final payment) will be provided at the time of booking or in your estimate/contract. You agree to pay all amounts due according to those terms. We may refuse or cancel Services if payment is not made as agreed.

-Changes to Services: Any additional work requested by you that is outside the original scope may result in additional charges.

We reserve the right to modify our pricing and service offerings at any time, but changes will not affect Services already agreed upon unless mutually updated.

3. User Responsibilities

3.1 Information Accuracy

You agree to provide accurate, current, and complete information when contacting us, requesting an estimate, or booking Services. You are responsible for updating us if your contact information or project details change.

3.2 Property Access and Safety

You agree to:

Provide safe and reasonable access to the property for our staff, vehicles, ladders, and equipment.

Inform us of any known hazards, structural issues, or electrical concerns related to your home or building.

Ensure that pets and children are kept away from work areas during installation or service.

If unsafe conditions are found, we may pause or refuse work until the issues are resolved.

3.3 Prohibited Conduct on the Site

You agree NOT to:

-Use the Site in a way that violates any applicable law or regulation.

-Interfere with or disrupt the operation of the Site or servers.

-Attempt to gain unauthorized access to any part of our systems or networks.

-Use automated tools (such as bots or scrapers) to access the Site without our prior written permission.

4. Intellectual Property Rights

All content on the Site—including text, images, graphics, logos, icons, design elements, and other materials—is owned by or licensed to EverGlow Lighting and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, display, or create derivative works from any content on the Site without our prior written consent.

Any logos, brand names, or product names (including “Govee”) may be trademarks of their respective owners and are used only to describe the nature of our services.

5. Third-Party Services

Our Site and Services may involve or reference third-party platforms and tools, such as:

-Website hosting and CRM services

-Messaging and communication services

-Payment processors

-Lighting manufacturers

We are not responsible for the content, policies, or actions of these third parties. Your use of any third-party service is subject to that third party’s terms and privacy policies.

6. Warranties and Disclaimers

6.1 Service Disclaimer

We strive to provide high-quality installation and service. However, except as specifically stated in a written service agreement, we provide our Site and Services “as is” and “as available,” without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Any manufacturer warranties (such as Govee product warranties) are provided by the manufacturer, not by EverGlow Lighting. You are responsible for reviewing and submitting any warranty claims with the product manufacturer unless otherwise agreed.

6.2 Website Disclaimer

We do not guarantee that the Site will be error-free, secure, or continuously available. From time to time, the Site may be unavailable due to maintenance or technical issues.

7. Limitation of Liability

To the maximum extent permitted by law, EverGlow Lighting and its owners, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to:

Your use or inability to use the Site

Any delay, cancellation, or rescheduling of Services

Any reliance on information or materials provided on the Site

In no event shall our total liability to you for all claims related to the Services or Site exceed the total amount you paid to EverGlow Lighting for the specific project or service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless EverGlow Lighting and its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Site or Services

Your violation of these Terms

Your violation of any rights of a third party

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date at the top of this page. Any changes will be effective when posted on the Site.

By continuing to use the Site or Services after changes are posted, you agree to the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Nebraska, and you consent to the exclusive jurisdiction and venue of such courts.

11. Termination

We may suspend or terminate your access to the Site or decline to provide Services at any time, with or without cause, and without prior notice, including if we believe you have violated these Terms.

Sections that by their nature should survive termination (such as Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will continue to apply after termination.
